HISTORIC VICTORY OF HELLENIC INVESTORS ASSOCIATION AGAINST FF!

Greek Justice and Hellenic Investors Association re-establish trust to the Stock Investment Principles and Respect to Shareholders Assets

The Board of Directors of Hellenic Investors Association is proud to announce that after the official publication of the unprecedented decision of the Court of First Instance of Athens Nu. 2419/2019, the petition for preliminary measures of 56 investors against FF has been accepted and that all assets, tangible or intangible of the defendants, namely the Company, the members of the Board of Directors and Auditors, may be provisionally seizured up to the amount of 1,8 million euros invested to financial instruments by the above investors – members of HEL.IN.AS.

Despite the strong argumentative by multiple legal representatives of the defendants that investors should abstain from the negotiations between the company and its’ creditors and that there was no chance that they could ever be compensated more than 1% of their initial investments, our Association remained adamant and resilient on behalf of the rights of it’s members and achieved a triumph: The decision orders the defendants to compensate all asset classes owners, not only in stocks but bonds and derivatives, at the amount of their INITIAL INVESTMENT. The decision in it’s interpretation is a hymn to the protection of shareholders investments, and literally unprecedented in Greek Jurisprudence. Its’ judgement is also pioneering with regard to the legal responsibility of Chartered Auditors of Enlisted Companies, the first in its’ kind that expressly legitimizes the liability of Auditors for compensation of investors in such circumstances as they are relevant to tort or negligence.

The loud and demanding voice of a demanding activist group of minority shareholders, organized and legally represented by a Proxy Association has brought JUSTICE and as a result we believe that our Association will be from now on a strong advocate to the rights of investors, Greek or foreign, who were continuously undermined until now. Our motto remains that the only lost battle is the one that was never fought!
